China Taiwan Net, December 2 According to the official website of the Ministry of Human Resources and Social Affairs, the "Interim Measures for Hong Kong, Macau, and Taiwanese Residents to Participate in Social Insurance in the Mainland (Mainland)" has been reviewed by the Ministry of Human Resources and Social Security Ministry's Council and the National Medical Security Bureau Adopted, effective from January 1, 2020.

Accordingly, from January 1 next year, Hong Kong, Macao and Taiwan residents who work, live and study in the Mainland (Mainland) will have social security cards. Like Mainland (Mainland) residents, they have the legal rights to participate in social insurance and enjoy social insurance benefits.

Attachment: Interim Measures for Hong Kong, Macau, Taiwanese Residents to Participate in Social Insurance in the Mainland (Mainland)

Article 1 In order to protect the lawfulness of Chinese citizens and residents of the Taiwan region (hereinafter referred to as Hong Kong, Macao and Taiwan residents) in the Hong Kong Special Administrative Region and Macao Special Administrative Region who work, live and study in the Mainland (Mainland), it is legal to participate in social insurance and enjoy social insurance benefits. Rights, strengthen social insurance management, and formulate these measures in accordance with the "Social Insurance Law of the People's Republic of China" (hereinafter referred to as the Social Insurance Law) and other provisions.

Article 2 Employers (hereinafter referred to as employers) who are legally registered or registered in the mainland (mainland) of enterprises, public institutions, social organizations, and individual economic organizations with employees (hereinafter referred to as employers) shall participate in the workforce in accordance with law The basic endowment insurance, employee basic medical insurance, work injury insurance, unemployment insurance and maternity insurance shall be paid by the employer and the individual in accordance with regulations.

Hong Kong, Macao, and Taiwan residents who engage in self-employed business in the Mainland (Mainland) according to law can participate in the basic pension insurance and basic medical insurance for employees in accordance with the relevant provisions of the registered place; You can participate in the basic old-age insurance for employees and basic medical insurance for employees in accordance with the relevant regulations of the place of residence.

Non-employed Hong Kong, Macao and Taiwan residents who live in the Mainland (Mainland) and apply for residence permits for Hong Kong, Macao and Taiwan residents can participate in the basic endowment insurance for urban and rural residents and the basic medical insurance for urban and rural residents in accordance with regulations at the place of residence.

University students from Hong Kong, Macao and Taiwan studying in the Mainland (Mainland) implement the same medical insurance policies as those from the Mainland (Mainland) and participate in basic medical insurance for urban and rural residents where higher education institutions are located.

Article 3 Where an employer employs or recruits residents of Hong Kong, Macao and Taiwan in accordance with the law, it shall hold a valid certificate of Hong Kong, Macao and Taiwan residents, as well as proof of employment contracts, employment contracts, etc., to register for social insurance for them. Residents of Hong Kong, Macao and Taiwan who engage in self-employed business and flexible employment in the Mainland (Mainland) in accordance with the law shall handle social insurance registration in accordance with the relevant regulations on the place of registration (place of residence).

Hong Kong, Macao and Taiwan residents who have already applied for Hong Kong, Macao and Taiwan residents' residence permits and meet the conditions for participating in the basic endowment insurance for urban and rural residents and basic medical insurance for urban and rural residents in the Mainland (Mainland).

Article 4 The various business processes for Hong Kong , Macao and Taiwan residents to apply for social insurance are the same as those for the mainland (mainland) residents. Social insurance agencies or social security card management agencies shall establish social security numbers for Hong Kong, Macao and Taiwan residents and issue social security cards.

Citizenship numbers obtained by residents of Hong Kong, Macao and Taiwan when they apply for residence permits are used as their social security numbers; social security numbers of Hong Kong and Macao residents who do not have citizenship numbers are compiled by the social insurance agency or social security card management agency in accordance with unified national regulations.

Article 5 Hong Kong, Macao and Taiwan residents participating in social insurance enjoy social insurance benefits in accordance with law.

Article 6 When the residents of Hong Kong, Macao and Taiwan participating in the basic endowment insurance for employees reach the statutory retirement age, if the accumulated payment is less than 15 years, the payment may be extended to full 15 years. If the social insurance law is enrolled before the implementation of the insurance and the payment is extended for 5 years and is still less than 15 years, the one-time payment can be made up to 15 years.

Hong Kong, Macao and Taiwan residents participating in the basic endowment insurance for urban and rural residents who meet the conditions for receiving benefits shall receive basic endowment insurance benefits for urban and rural residents in accordance with relevant regulations at the place of residence. When the age for receiving benefits is reached and the accumulated payment is less than 15 years, the payment may be extended or repaid in accordance with relevant regulations.

Residents of Hong Kong, Macao and Taiwan participating in the basic medical insurance for employees who have reached the statutory retirement age and whose contributions have reached the nationally prescribed years will no longer pay the basic medical insurance premiums after retirement and enjoy basic medical insurance treatment in accordance with national regulations; Payment to the nationally prescribed period. The payment period for retirees to enjoy basic medical insurance benefits shall be implemented in accordance with local regulations.

Hong Kong, Macao and Taiwan residents participating in the basic medical insurance for urban and rural residents shall pay the same standards as urban and rural residents in their co-ordination areas and enjoy the same basic medical insurance treatment.

Medical expenses incurred by residents of Hong Kong, Macao and Taiwan participating in the basic medical insurance are not included in the payment scope of the basic medical insurance fund.

Article 7 If residents of Hong Kong , Macao and Taiwan leave the Mainland (Mainland) before meeting the required conditions for receiving pensions, their social insurance personal accounts shall be retained. If they come to the Mainland (Mainland) for employment, residence and continued payment, the payment period shall be calculated cumulatively; If I apply in writing to terminate the social insurance relationship, I may pay the amount of the savings in my social insurance personal account to me at one time.

For former mainland (mainland) residents who have obtained Hong Kong, Macau, and Taiwan resident status, if they choose to retain their social insurance relationship when leaving the mainland (mainland), return to the mainland (mainland) for employment, residence, and continue to participate in insurance, the original payment period is combined; If you have chosen to terminate the social insurance relationship when you leave the Mainland (Mainland), the original payment period will no longer be combined, and you can pay the one-time deposit amount of your social insurance personal account.

Article 8 When Hong Kong, Macao and Taiwan residents participating in social insurance move in the cross-coordinated areas of the mainland (mainland) to handle the transfer of social insurance relations, they shall follow the relevant state regulations. Residents of Hong Kong, Macao and Taiwan who participate in the basic endowment insurance of enterprise employees are not applicable to the relevant provisions for establishing temporary basic endowment insurance payment accounts. Those who have already received the pension insurance benefits will no longer go through the formalities of transferring the basic pension insurance relationship. Those who have already enjoyed the medical insurance benefits of retirees will no longer go through the formalities of transfer of basic medical insurance relations.

Hong Kong, Macao, and Taiwan residents participating in the basic endowment insurance for employees who migrate across provinces for employment shall transfer the basic endowment insurance relationship. Article 9 Residents of Hong Kong, Macao and Taiwan who receive basic endowment insurance and work injury insurance benefits on a monthly basis shall apply for certification of treatment eligibility in accordance with the regulations of social insurance agencies.

Hong Kong, Macao and Taiwan residents who receive basic endowment insurance, work injury insurance and unemployment insurance benefits on a monthly basis shall lose their eligibility requirements, and they or their relatives shall truthfully report the situation to the social insurance agency within one month. Benefits received in excess of the unsolicited report shall be promptly returned to the social insurance agency.

Article 10 Financial authorities at all levels shall provide subsidies to Hong Kong, Macao and Taiwan residents in the mainland (mainland) who participate in basic endowment insurance for urban and rural residents and basic medical insurance for urban and rural residents (excluding Hong Kong, Macao and Taiwan university students) in accordance with the same standards as urban and rural residents in their co-ordinated areas.

Finances at all levels shall implement the subsidy policy for Hong Kong, Macao and Taiwan university students to participate in basic medical insurance for urban and rural residents in accordance with relevant regulations.

Article 11 Hong Kong, Macao, and Taiwan residents who have participated in local social insurance in Hong Kong, Macau, and Taiwan, and continue to maintain social insurance relations, may hold certificates issued by relevant authorized institutions and not participate in the basic endowment insurance and unemployment insurance in the Mainland (Mainland).

Article 12 Where the Mainland (Mainland) and relevant agencies in Hong Kong, Macau, or Taiwan make specific arrangements for social insurance matters, they shall be handled in accordance with relevant regulations.

Article 13 The social insurance administrative department or social insurance premium collection agency shall supervise and inspect the participation of Hong Kong, Macao and Taiwan residents in social insurance in accordance with the provisions of the Social Insurance Law. If the employer fails to register social insurance for the hired or recruited Hong Kong, Macao and Taiwan residents or fails to pay social insurance premiums according to law, it shall be handled in accordance with the laws, administrative regulations and relevant regulations of the Social Insurance Law.

Article 14 The "valid Hong Kong, Macao and Taiwan resident certificate" as referred to in the Measures refers to the Hong Kong and Macao residents 'permit to and from the Mainland, and the Hong Kong, Macao and Taiwan residents' residence permits.

Article 15 These Measures shall be implemented as of January 1, 2020.
